Terms of Service

1. About ISLA

ISLA is a platform operated from the Netherlands for vinyl record collectors to discover, log, and share music. By accessing or using ISLA (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to use ISLA. By creating an account, you represent that you meet this age requirement. If you are under 18, you confirm that you have parental or guardian consent.

3. Account

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

You retain ownership of content you post (photos, text, collection data). By posting content, you grant ISLA a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the Service. You are responsible for ensuring you have the right to share any content you post.

5. Prohibited Conduct

You agree not to:

  • Use the Service for illegal purposes
  • Post content that infringes intellectual property rights
  • Harass, abuse, or threaten other users
  • Attempt to gain unauthorized access to the Service
  • Use automated tools to scrape or collect data from the Service
  • Impersonate another person or entity

6. Intellectual Property

The ISLA name, logo, design, and underlying technology are owned by ISLA. Record cover images and metadata are sourced from third-party databases and remain the property of their respective rights holders. ISLA does not claim ownership of third-party content displayed on the platform.

7. Disclaimers

The Service is provided “as is” without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Record pricing, availability, and shop information may not be accurate or up to date.

8. Limitation of Liability

To the maximum extent permitted by Dutch law, ISLA shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid to ISLA in the twelve months preceding the claim.

9. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service. Continued use after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in Amsterdam, the Netherlands. This does not affect your statutory rights as a consumer under EU law, including your right to bring proceedings in the courts of your country of residence.

12. Online Dispute Resolution (EU)

In accordance with Regulation (EU) No 524/2013, the European Commission provides an online platform for the resolution of disputes between consumers and traders, available at https://ec.europa.eu/consumers/odr. If you are an EU consumer and have a complaint about a service purchased from ISLA online, you may use this platform to submit your dispute.

ISLA is not obliged to participate in alternative dispute resolution proceedings before a consumer arbitration body, but is willing to do so where required by law. Our contact email for ODR-related complaints is guido@dig-isla.com.

13. Right of withdrawal (EU consumers)

Under EU consumer law, EU consumers who purchase a digital service have a 14-day right of withdrawal from the date of contract conclusion. By confirming a paid subscription, you agree that the service begins immediately and acknowledge that your right of withdrawal lapses once the service has been fully performed. ISLA is currently free to use; this section will apply once paid features are introduced.
